اتفاقية طالب الخدمة

الحالة: اتفاقية حاكمة

النطاق: تشمل جميع الأنشطة والعلاقات بين طالب الخدمة ومنظومة بال لانسر.

أولًا: مقدمة

تهدف هذه الاتفاقية إلى تحديد الشروط والأحكام التي تحكم العلاقة بين طالب الخدمة ومنظومة بال لانسر، بما يضمن الامتثال للقوانين واللوائح المعمول بها.

ثانيًا: التعريفات

في هذه الاتفاقية، يكون للمصطلحات التالية المعاني المحددة لها كما يلي: "طالب الخدمة" يشير إلى الشخص أو الكيان الذي يطلب خدمات من خلال المنصة، "المنصة" تشير إلى منظومة بال لانسر، و"الخدمات" تشير إلى أي خدمة مقدمة من خلال المنصة.

ثالثًا: نطاق التطبيق

تسري هذه الاتفاقية على جميع طلبات الخدمات المقدمة من خلال المنصة، وتشمل جميع الأنشطة ذات الصلة التي يقوم بها طالب الخدمة.

رابعًا: حقوق والتزامات الأطراف

يحق لطالب الخدمة الحصول على الخدمات المتفق عليها وفقًا للشروط المحددة، ويلتزم بدفع الرسوم المستحقة في الوقت المحدد. تلتزم المنصة بتوفير الخدمات بجودة عالية وفقًا للمعايير المتفق عليها.

خامسًا: إدارة النزاعات

في حالة نشوء أي نزاع بين الأطراف، يتم حله وديًا من خلال التفاوض. إذا لم يتم التوصل إلى حل، يمكن اللجوء إلى التحكيم وفقًا للقوانين المعمول بها.

سادسًا: المعاملات المالية

تتم جميع المعاملات المالية من خلال القنوات المعتمدة من قبل المنصة، ويجب على طالب الخدمة التأكد من صحة المعلومات المالية المقدمة.

سابعًا: حماية البيانات والخصوصية

تلتزم المنصة بحماية بيانات طالب الخدمة وفقًا لسياسة الخصوصية المعتمدة، ولا يتم مشاركة البيانات مع أطراف ثالثة دون موافقة مسبقة.

ثامنًا: التعديلات على الاتفاقية

تحتفظ المنصة بالحق في تعديل هذه الاتفاقية من وقت لآخر، ويتم إخطار طالب الخدمة بأي تغييرات جوهرية قبل تنفيذها.

تاسعًا: الإنهاء

يمكن لأي من الأطراف إنهاء هذه الاتفاقية بإشعار كتابي مسبق للطرف الآخر، مع مراعاة الشروط التعاقدية المتعلقة بالإنهاء.

عاشرًا: القوة القاهرة

لا يتحمل أي من الأطراف المسؤولية عن التأخير أو الفشل في الأداء الناتج عن أحداث خارجة عن إرادته، مثل الكوارث الطبيعية أو الأزمات الصحية.

حادي عشر: القانون الواجب التطبيق

تخضع هذه الاتفاقية وتفسر وفقًا للقوانين المعمول بها في دولة فلسطين، ويكون للمحاكم الفلسطينية الاختصاص القضائي الحصري.

ثاني عشر: السرية

يلتزم الأطراف بالحفاظ على سرية المعلومات المتبادلة وعدم استخدامها لأي غرض غير مصرح به.

ثالث عشر: التنازل

لا يجوز لأي طرف التنازل عن حقوقه أو التزاماته بموجب هذه الاتفاقية دون موافقة كتابية مسبقة من الطرف الآخر.

رابع عشر: الإشعارات

تعتبر جميع الإشعارات والاتصالات المرسلة بموجب هذه الاتفاقية صحيحة إذا أرسلت إلى العناوين المحددة في هذه الاتفاقية.

Service Requester Agreement

Status: Governing Agreement

Scope: Covers all activities and relationships between the Service Requester and the PalLancer Ecosystem.

1. Introduction

This agreement aims to establish the terms and conditions governing the relationship between the Service Requester and the PalLancer Ecosystem, ensuring compliance with applicable laws and regulations.

2. Definitions

In this agreement, the following terms shall have the meanings assigned to them: "Service Requester" refers to the person or entity requesting services through the platform, "Platform" refers to the PalLancer Ecosystem, and "Services" refers to any service provided through the platform.

3. Scope of Application

This agreement applies to all service requests made through the platform and includes all related activities carried out by the Service Requester.

4. Rights and Obligations of the Parties

The Service Requester is entitled to receive the agreed services according to the specified terms and is obliged to pay the due fees on time. The platform is committed to providing services of high quality in accordance with the agreed standards.

5. Dispute Management

In the event of any dispute between the parties, it shall be resolved amicably through negotiation. If no resolution is reached, arbitration may be sought in accordance with applicable laws.

6. Financial Transactions

All financial transactions are conducted through the channels approved by the platform, and the Service Requester must ensure the accuracy of the financial information provided.

7. Data Protection and Privacy

The platform is committed to protecting the Service Requester's data in accordance with the approved privacy policy, and data will not be shared with third parties without prior consent.

8. Amendments to the Agreement

The platform reserves the right to amend this agreement from time to time, and the Service Requester will be notified of any material changes before they are implemented.

9. Termination

Either party may terminate this agreement with prior written notice to the other party, subject to the contractual terms related to termination.

10. Force Majeure

Neither party shall be liable for any delay or failure in performance resulting from events beyond their control, such as natural disasters or health crises.

11. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Palestine, and the Palestinian courts shall have exclusive jurisdiction.

12. Confidentiality

The parties agree to maintain the confidentiality of exchanged information and not to use it for any unauthorized purpose.

13. Assignment

No party may assign its rights or obligations under this agreement without the prior written consent of the other party.

14. Notices

All notices and communications under this agreement shall be deemed valid if sent to the addresses specified in this agreement.
