اتفاقية المستخدم الفردي

الحالة: اتفاقية حاكمة

النطاق: تشمل جميع الأنشطة والعلاقات بين المستخدم الفردي ومنظومة بال لانسر.

أولًا: مقدمة

تهدف هذه الاتفاقية إلى تحديد الشروط والأحكام التي تحكم استخدام الأفراد لمنصة بال لانسر، وتوضح حقوق والتزامات الطرفين لضمان تجربة استخدام آمنة وفعالة.

ثانيًا: التعريفات

في هذه الاتفاقية، يكون للكلمات والعبارات التالية المعاني المحددة لها، ما لم يقتض السياق خلاف ذلك: "المنصة" تعني منظومة بال لانسر، "المستخدم" يعني الفرد الذي يوافق على هذه الاتفاقية ويستخدم خدمات المنصة.

ثالثًا: نطاق التطبيق

تسري هذه الاتفاقية على جميع الأفراد الذين يستخدمون منصة بال لانسر، وتشمل جميع الأنشطة التي يقوم بها المستخدم ضمن المنصة.

رابعًا: حقوق والتزامات الأطراف

يلتزم المستخدم بالامتثال لجميع القوانين واللوائح المعمول بها عند استخدام المنصة، كما يحق له الوصول إلى الخدمات المتاحة وفقًا للشروط المحددة في هذه الاتفاقية.

خامسًا: إدارة النزاعات

في حالة نشوء أي نزاع بين المستخدم والمنصة، يتم التعامل معه وفقًا لإجراءات إدارة النزاعات المحددة في هذه الاتفاقية، بما في ذلك الوساطة والتحكيم.

سادسًا: المعاملات المالية

يجب على المستخدم الالتزام بجميع الشروط المالية المنصوص عليها في هذه الاتفاقية، بما في ذلك الرسوم والدفعات المستحقة للمنصة.

سابعًا: حماية البيانات والخصوصية

تلتزم المنصة بحماية بيانات المستخدمين الشخصية وفقًا لسياسة الخصوصية المعتمدة، ويجب على المستخدم قراءة وفهم هذه السياسة قبل استخدام المنصة.

ثامنًا: التعديلات على الاتفاقية

تحتفظ المنصة بالحق في تعديل هذه الاتفاقية من وقت لآخر، وسيتم إخطار المستخدمين بأي تغييرات جوهرية عبر البريد الإلكتروني أو من خلال إشعار على المنصة.

تاسعًا: الإنهاء

يمكن للمستخدم إنهاء هذه الاتفاقية في أي وقت عن طريق إغلاق حسابه، كما تحتفظ المنصة بالحق في إنهاء الاتفاقية في حالة انتهاك المستخدم لأي من شروطها.

عاشرًا: القوة القاهرة

لا تتحمل المنصة أي مسؤولية عن التأخير أو الفشل في الأداء الناتج عن أحداث خارجة عن سيطرتها، مثل الكوارث الطبيعية أو الأزمات الصحية.

حادي عشر: القانون الواجب التطبيق

تخضع هذه الاتفاقية وتفسر وفقًا للقوانين المعمول بها في دولة فلسطين، وأي نزاع ينشأ عنها يكون من اختصاص المحاكم الفلسطينية.

ثاني عشر: السرية

يتعهد المستخدم بالحفاظ على سرية جميع المعلومات التي يحصل عليها من خلال استخدام المنصة وعدم إفشائها لأي طرف ثالث دون موافقة خطية مسبقة من المنصة.

ثالث عشر: التنازل

لا يجوز للمستخدم التنازل عن أي من حقوقه أو التزاماته بموجب هذه الاتفاقية دون الحصول على موافقة خطية مسبقة من المنصة.

رابع عشر: الإشعارات

تعتبر جميع الإشعارات المرسلة إلى المستخدم عبر البريد الإلكتروني أو من خلال إشعار على المنصة قد تم تسليمها بشكل صحيح وفعّال.

Individual User Agreement

Status: Governing Agreement

Scope: Covers all activities and relationships between the individual user and the PalLancer Ecosystem.

1. Introduction

This agreement aims to set forth the terms and conditions governing the use of the PalLancer platform by individuals, outlining the rights and obligations of both parties to ensure a safe and efficient user experience.

2. Definitions

In this agreement, the following words and phrases shall have the meanings assigned to them, unless the context requires otherwise: "Platform" means the PalLancer Ecosystem, "User" means the individual who agrees to this agreement and uses the platform's services.

3. Scope of Application

This agreement applies to all individuals using the PalLancer platform and encompasses all activities conducted by the user within the platform.

4. Rights and Obligations of the Parties

The user is obligated to comply with all applicable laws and regulations when using the platform, and is entitled to access available services in accordance with the terms specified in this agreement.

5. Dispute Management

In the event of any dispute between the user and the platform, it shall be managed in accordance with the dispute management procedures set forth in this agreement, including mediation and arbitration.

6. Financial Transactions

The user must adhere to all financial terms stipulated in this agreement, including fees and payments due to the platform.

7. Data Protection and Privacy

The platform is committed to protecting users' personal data in accordance with the approved privacy policy, and users must read and understand this policy before using the platform.

8. Amendments to the Agreement

The platform reserves the right to amend this agreement from time to time, and users will be notified of any material changes via email or through a notice on the platform.

9. Termination

The user may terminate this agreement at any time by closing their account, and the platform reserves the right to terminate the agreement in the event of any breach of its terms by the user.

10. Force Majeure

The platform shall not be liable for any delay or failure in performance resulting from events beyond its control, such as natural disasters or health crises.

11. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Palestine, and any dispute arising therefrom shall be subject to the jurisdiction of Palestinian courts.

12. Confidentiality

The user agrees to maintain the confidentiality of all information obtained through the use of the platform and not to disclose it to any third party without prior written consent from the platform.

13. Assignment

The user may not assign any of their rights or obligations under this agreement without prior written consent from the platform.

14. Notices

All notices sent to the user via email or through a notice on the platform shall be deemed to have been properly and effectively delivered.
